One More Time: Wal-Mart Sued Again in Class Action Suit

I just got wind of a lawsuit, apparently filed by the EEOC, against Wal-Mart charging race discrimination in hiring of truck drivers. This class action suit claims that the company "deters and rejects African-American applicants for truck driving jobs, limiting their employment opportunities." The report continues by saying that the hiring manager used "racial stereotyping" to deny the plaintiff the position because of his "gut feeling" that the plaintiff had falsified his credit and driving records."

From the description, this sounds more like a "disparate treatment" approach to the lawsuit, than many recent lawsuits, which have relied on a "disparate impact" approach to discrimination.
